Who these terms are with
This site and the client portal at clients.truenorthdigital.com.au are operated by True North Digital Pty Ltd, 114 Brougham Street, Potts Point NSW 2011, Australia. By using either, you agree to what follows. If you do not, please do not use them.
If you are a client
Your services agreement with us governs the work we do for you: what we deliver, what it costs and how long it runs. Nothing on this page changes that agreement. These terms cover the website and the portal as software, and where the two conflict, your signed agreement wins.
Accounts
Portal accounts are issued by us or by an administrator at your organisation; you cannot sign yourself up. Keep your login to yourself, do not share it, and tell us promptly if you think someone else has it. You are responsible for what happens under your account. We may suspend an account that is being misused, or when someone leaves the organisation it belongs to.
Using the site and the portal properly
Do not attempt to access data belonging to another organisation, probe or interfere with the service’s security, scrape it at volume, resell access to it, or use it to break the law. Automated access outside the features we provide is not permitted without our written agreement.
Your data and connected platforms
Where you connect a third-party account — analytics, search, business listings, advertising or social — you confirm you are entitled to grant that access. We use it only to produce your reporting, as described in our privacy policy. Those platforms are run by other companies under their own terms, and we are not responsible for their availability, their accuracy or changes they make. You can withdraw access at any time.
The business data in your workspace remains yours. Reports, dashboards, analysis and recommendations we produce for you are yours to use within your own business.
Our material
The portal software, this website, and the design, text and images on them remain ours or our licensors’. You may read, download and share our published material for your own reference; you may not copy it for commercial use, or reproduce the software.
Availability
We work to keep the portal available and accurate, but we do not guarantee it will be uninterrupted or error-free. Data arriving from third-party platforms can be delayed, restated or withdrawn by those platforms, and figures are provided for guidance rather than as a warranty. We may change or withdraw features, and we will not remove something a client depends on without telling them.
Liability
Nothing here excludes rights you have under the Australian Consumer Law or other law that cannot be excluded. Subject to that, we are not liable for indirect or consequential loss, or for loss of profit, revenue or data, and our total liability arising from your use of the site or the portal is limited to resupplying the service or the amount you paid us for it in the preceding twelve months.
Changes
We update these terms when the service changes. The date at the top says when they last changed, and continuing to use the service after a change means you accept it.
Governing law
These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction.
